The works ordered are invoiced at the price in force at the time of registration of the order. When ordering internationally: shipping, brokerage and customs are the responsibility of the recipient. These rights and costs are not the responsibility of the artist Bastien. They will be at your expense and are your sole responsibility both in terms of declarations and payments to the competent authorities and bodies in your country.
The order and the validation of the transaction: When you confirm your order by clicking on the «order» button, you declare to have read and accepted the entirety of these general conditions of sale. Upon registration of your order, an acknowledgement of receipt will be sent to you by email after validation of payment. However, we reserve the right to cancel any order from a customer with whom there is a dispute regarding the payment of a previous order.
Payment: The payment of your purchases is in Canadian dollars only. By PayPal: it is done online when placing the order. Simple and secure payment with PayPal. The information is integrated into the online shopping system.
Delivery: Delivery times vary depending on the destination address. In Canada, delivery varies between 14 days and 21 days (an email will be sent for this purpose). The service included with your order is a regular Canada Post service. It is possible to ship by another carrier and/ or get an Express service, please contact me for costs and deadlines. Reserve when receiving works. It is up to you in case of failure or damage, to issue precise and detailed reservations to the carrier, by showing «subject to reservation/ subject to verification/ damaged» on the delivery note, in order to benefit from the insurance contracted. It is necessary to email the list of damages to Bastien - artist no later than 72 hours after delivery.
Rights on the work and intellectual property: the artist Bastien remains owner of the copyright. The rights of representation and reproduction of the works on the site www.nbastie.com belong to the author the artist Bastien and the studio Bastien - artist. It is necessary to have joint authorization for any exploitation of these rights. All elements appear on the site are protected by copyright, trademark law and any other intellectual property rights. No reproduction and/ or adaptation can be made without the permission of Bastien artist.

Returns
In the event that a work purchased online via nbastie.com does not meet the customer’s expectations, a return without exchange is possible on the following terms and conditions.
— Up to 48 hours after receiving your order:
   - Refund of 90% of the total cost of the returned work, including taxes;
   — Return of the work in its original box, at the expense of Bastien-artiste.

— Between 48 hours and 10 days after receiving your order:
  - Future purchase credit equal to 90% of the total cost of the returned work, including taxes;
  — Return of the work in its original box, at the expense of Bastien-artiste.

It is the client’s responsibility to contact Bastien-artiste’s customer service at 1-438-390-7601 or by email at info@nbastie.com to make an agreement before returning a work. Note: A return cannot be made without this step. Following this process, an email containing a prepaid return label will be sent to the customer. The work and, if applicable, its frame must be returned in their original condition, in perfect condition, in the original box. Bastien-artiste reserves the right to refuse a refund or credit if these conditions are not respected.

 


Once the artwork is received by Bastien-artiste, the client’s request will be processed within one (1) to five (5) working days. The customer will receive an email notification once the return is processed. If applicable, a credit for future purchase will be issued or a refund will be credited to the original payment method. Note that processing a refund by the financial institution may take up to three (3) to five (5) more business days.

 


Exchanges
In the event that a work purchased online via nbastie.com does not meet the customer’s expectations, a return with exchange is possible on the following terms and conditions.
— Up to 10 days from receipt of your order:
   - Exchange value equal to 100% of the total cost of the work to be exchanged, including taxes;
   - Exchanges of equal or greater value accepted;
   — Work to bring back to Bastien-artiste, in its original box and at the client’s expense. No exchanges accepted by mail or courier.

The work and, if applicable, its frame must be returned in their original condition, in perfect condition, in the original box. Bastien-artiste reserves the right to refuse any exchange if these conditions are not respected.

ONLINE PURCHASE POLICY and our privacy policy

Online shopping policy

Bastien-artiste, referred to in this policy as “Bastien Artist”, operates nbastie.com. Bastien-artiste is committed to ensuring that your shopping experience via its website is pleasant, simple and effective.

Bastien-artiste kindly asks you to carefully read this online purchase policy. By making an online purchase, you acknowledge that you have read and understood the terms of use of the website and this purchase policy and agree to abide by them, as well as any changes.

 

Online orders

From nbastie.com, it is possible to view more than 50 original works, paintings and derivative products, and to read the information available on each work before adding it to the shopping cart. For each work, a window containing an enlarged image and a detailed description is visible when the thumbnail of the work is selected from the page of the artist Bastien. A user of the site who wishes to buy a work simply has to click on the «Buy» button at the bottom of the enlarged image and the work will be automatically transferred to the shopping cart. You can view the contents of the shopping cart at any time by clicking on the shopping cart icon at the top right of the screen. The contents of the shopping cart can be modified at will, in particular to remove items that are no longer the subject of an intention to purchase (by clicking on the trash icon to the right of the item description).

 

Only original works, paintings and derivative products can be purchased online. Customers and users of the website who wish to purchase one or more reproductions can do so by contacting Bastien-artiste customer service at 1-438-390-7601 or by email at info@nbastie.com

 

Once the online shopping session is complete, and the shopping cart is verified, simply click on «Payment» to fill in the fields related to the billing address, delivery address and payment method. A summary of the transaction will then appear on the screen, including a summary showing the description of the items ordered, the purchase price of each item and the applicable taxes.

 

Order Verification

It is possible to check and modify the shopping cart, as well as the billing, delivery and payment data as many times as desired before clicking on «Place the order», operation thanks to which the online purchase will take effect. Once the transaction is completed, the total amount of the order will be automatically deducted.

 

Please note that it is not possible to cancel or make changes to an online order when all steps of the order have been completed. Customers who accidentally click on “Place Order” should refer to the Return Policy – Online Shopping section and contact Bastien-artiste customer service at 1-438-390-7601 or by email at info@nbastie.com as soon as possible.

 

Confirmation and acceptance of the order

When a user of the nbastie.com website places an order online (by clicking on «Place the order»), they receive an automated email informing them of the receipt of their order to Bastien-artiste. This order confirmation email will be sent to the customer at the email address provided at the time of purchase, within 10 minutes of the order. This document confirms the payment, but is not an invoice. The order constitutes an offer made to Bastien-artiste for the purchase of the items indicated in the confirmation of the order, subject to the price and subject to the terms and conditions set out in the latter. Bastien-artiste is not bound by orders until she has accepted them.

 

The acceptance of the order by Bastien-artiste is attested by a second email that Bastien-artiste sends to the customer at the email address provided when ordering. Invalid transaction

The availability of the items presented on nbastie.com is limited in nature, so the original works are offered and visible on the pages of the artist Bastien until they are sold. However, this is not the case for works contained in the shopping cart of users; it may happen that a work sold is still in a shopping cart, even if the latter is no longer offered. A customer who tries to buy an out-of-stock work would then see on the screen the mention «Certain items in your cart are no longer available/ Some items in your cart are invalid» after clicking on «Place order». If such a situation occurs, clients are asked to contact Bastien-artiste customer service as soon as possible at 1-438-390-7601 or by email at info@nbastie.com

 

Payment

 

Motto

All prices quoted are in Canadian dollars and all orders are processed in Canadian dollars.

 

Applicable taxes

Prices displayed on the website do not include sales taxes (if applicable).

 

Bastien-artiste collects sales tax on items ordered through its website. The sales tax rate that will apply to an order depends on the delivery address of the order. Federal Goods and Services Tax (GST) of 5% and Quebec Sales Tax (QST) of 9.975% apply to works shipped to Quebec. Only GST (5%) applies on works shipped to Alberta. The Harmonized Sales Tax (HST) applies to the following provinces: Ontario (13%), Nova Scotia (15%), Prince Edward Island (15%), New Brunswick (15%), Newfoundland and Labrador (15%). GST (5%) and Provincial Sales Tax (PST) apply to works shipped to British Columbia (7%), Manitoba (7%) and Saskatchewan (6%).

 

Online pricing policy

The prices displayed on nbastie.com are identical to the gallery prices. No administration or transportation fees are added to online transactions. In case of discrepancy between the information displayed on this website and that available in gallery, the information available in gallery has priority.

 

Accepted method of payment

Transactions made through nbastie.com are only payable through PayPal

Online payment

Any purchase made through nbastie.com must be paid in full; the total amount of the order is charged at the time the order is placed on the website.

Purchase by installments, without fees or interest

For any purchase made with Bastien-artiste or by phone, the Bastien-artiste Courtesy Service allows payments to be spread over a defined period (6, 12, 24, 36, 48 months or more), without fees or interest.

 

Example of payment terms

For a total purchase of $3,600 CAD, payment can be made by:

6 payments of $600/month;

12 payments of $300/month;

24 payments of $150/month;

36 payments of $100/month or other, depending on the agreements reached.

Payments are made by monthly debit to a MasterCard, Visa or American Express credit card. The acquired work is sent without delay.

 

The nbastie.com website does not allow online installment purchases. However, those who wish to take advantage of the Bastien-artiste Courtesy Service or obtain additional information can do so by contacting Bastien-artiste Customer Service at 1-438-390-7601 or by email at info@nbastie.com

 

Official invoice

Any buyer who has made an online purchase on the website will receive by email the official invoice in PDF format, the digital photo of the purchased works, as well as any relevant information relating to the shipment of the order. Certificate of authenticity

Each original artwork sold by Bastien-artist comes with a completed and signed certificate of authenticity, included in an envelope affixed to the back of the canvas or on the package.

 

Credit card registration and data retention

When purchasing online through my site, Bastien-artiste only collects personal information necessary for the processing of a current or future order. A user’s personal information and credit card number required for online payment is only transmitted to the external provider responsible for processing online transactions. As a security measure, Bastien-artiste does not retain any credit card numbers provided as part of an online transaction through the website. Only the last four digits of the credit card used will be displayed in the order confirmation email to help identify the credit card used quickly. Delivery

 

A valid delivery address must be provided at the time of purchase. Delivery to a PO Box cannot be received.

 

Free shipping within Canada

Bastien-artiste has more than 10 years of experience in shipping works of art. This service is free for table and derivative shipments to Canada*.

* Some shipping restrictions apply to some remote areas including Nunavut, Yukon and Northwest Territories. Clients in these regions are invited to contact Bastien-artiste customer service at 1-438-390-7601 or by email at info@nbastie.com

 

International shipments

Products purchased through the Site may only be sold and distributed to customers in Canada; the nbastie.com website does not allow online purchase for customers outside of Canada. Those who wish to make an acquisition can do so by contacting Bastien-artiste customer service at 1-438-390-7601 or by email at info@nbastie.com . Orders placed outside of Canada, including from the United States, are not subject to the Canadian Federal Goods and Services Tax, applicable provincial sales taxes, or other Canadian taxes and duties associated with an order for products. For shipments outside Canada, the cost of delivery is based on the destination, weight, format and value of the works and includes any taxes and customs duties imposed by the authorities of the country of destination.

 

Packaging and handling

Bastien-artiste offers free packaging and handling services for purchases to be shipped. My competent staff makes every effort to ensure that the packages reach their destination in perfect condition. Very secure, shipments are carefully packaged in custom-made triple-thickness and/or styrofoam high density cardboard boxes.

 

Multiple shipping addresses

It is only possible to specify one shipping address per order. A customer wishing to shop online under different addresses will have to place each order separately.

 

Shipping services used

Online orders are shipped through courier companies (Purolator or UPS) or Canada Post and are shipped anywhere in Canada. Bastien-artiste reserves the right to choose the most appropriate carrier according to the format of the package, its weight and its destination. Quebec customers wishing to receive their package by bus (via the Expedibus service point closest to them) or customers wishing to take possession of their purchase at the Bastien-artist workshop are asked to contact Bastien-artiste customer serviceartist at 1-438-390-7601 or by email at info@nbastie.com before placing their order.

 

Delivery times

Online purchase orders are processed for shipping once the validation of the information provided has been completed. Orders placed outside business hours will be processed the next business day. Delivery times depend on the destination address. Delivery is generally made within one (1) to nine (21) business days (Monday to Friday, excluding holidays). However, please allow up to fifteen (30) business days for delivery to remote locations.

 

Deliveries are made during normal business hours, Monday to Friday, holidays not included. Due to factors related to delivery volumes and possible changes to the delivery route of the selected shipping services, it is impossible for Bastien-artiste to confirm the delivery time of the parcels.

 

If, due to an unforeseen event, Bastien-artiste is unable to deliver an item within the deadlines set out in this online purchase policy, Bastien-artiste will contact the customer to inform him of the reasons for the delay and make the necessary arrangements taking into account the new estimated delivery date.

 

Signature required on delivery

For his shipments, the option «signature required» is always retained by Bastien-artist to prevent a package from being left at its destination without anyone having taken possession of it. Bastien-artiste cannot be held responsible for non-compliance with its instructions or if the «signature required» service should be unavailable in a given region.

Package Tracking

At the time the online purchase order is shipped, Canada Post or the selected courier company will send an email to the email address provided during the order confirming that it was picked up and has left Bastien-artiste. The customer can track the package using the tracking number received in their shipping confirmation.

 

 If the customer is absent during the delivery attempt, the package will be delivered to a third party present at the delivery address. If no one is available to pick up the delivery, the package will be held at the postal outlet (Canada Post) or forwarded to the nearest drop-off point (Purolator, UPS) for delivery or pick up later. A delivery notice will be left indicating where and how to pick up the shipment.

 

 Please note that each additional delivery attempt involves an additional charge to the sender. Although these costs are not charged to the buyer, Bastien-artiste calls on the collaboration of the recipients to avoid additional delivery attempts, for reasons both economic and related to the security of the packages.

 

 Parcel Liability

All items purchased through nbastie.com are subject to a shipping contract, which means that Bastien-artiste assumes the risk of loss of the ordered items as soon as they are delivered to the carrier. Title to these items is transferred to the customer when they take possession of the package at destination, either at the delivery address provided during the online purchase order, at the courier company depot or at the Canada Post counter, the delivery date as proof.

Bastien-artiste will be able to take charge of the parcel tracking procedures with the carrier and the follow-up of the situation.

 

 Damage and breakage

Bastien-artiste has more than 10 years of experience in shipping works of art. Its competent staff makes every effort to ensure that the packages reach their destination in perfect condition. Despite these precautions and despite the exceptional nature of such incidents, it is not impossible that a breakage occurs during a shipment. It is also the customer’s responsibility to examine the package upon receipt. If a package is received damaged, the customer is required to:

 advise the carrier of the condition of the package and have the carrier sign the delivery note against this finding;
Clearly photograph the outer packaging and damage to its contents and email the photos to info@nbastie.com with a detailed description of the damage within 48 hours of receiving the package.
If the customer meets at least one of these conditions, the damaged work received may be refunded in full, replaced by a work of equivalent value or credited on a future purchase online or at the Bastien-artist workshop, at the customer’s convenience. To this end, the client is invited to contact Bastien-artiste customer service at 1-438-390-7601 or by email at info@nbastie.com as soon as possible.

 

 Disclosure of personal information

Bastien-artiste uses courier companies and the postal service to provide shipping services. If necessary, contact information collected from customers is shared with these companies, solely for shipping and delivery purposes. Although the chosen suppliers have some of the best privacy policies in the industry, Bastien-artiste cannot be held responsible for any damages resulting from the use of this information by these employees.

 Limits

 

Bastien-artiste reserves the right to refuse any order placed on its website. In case of modification of an order or cancellation, Bastien-artiste will try to warn the buyer by communicating with the latter at the coordinates provided when ordering.
